On Monday, the 13-year-old boy who admitted to fatally stabbing his mother inside their Hialeah apartment last year was scheduled to attend another status hearing. For reasons that are currently unknown, the hearing has been canceled. In April, Derek Rosa failed to attend a status hearing, however, his family was present at the courthouse during the hearing.
Over 50 supporters rallied alongside the family, all asserting the teenager’s innocence.
The courtroom was packed with people eagerly waiting to hear the judge and attorneys address the case. After the proceedings, the crowd gathered outside the courthouse and chanted in unison.
Numerous Miami-Dade police officers advised the crowd to move away from the entrance and stand on the sidewalks. Dayliset Rielo, the attorney of Rosa, clarified that the supporters who showed love and appreciation towards Rosa’s family were not associated with the legal team. Despite the admiration, they have no affiliation with the case.
In February, Rosa was dressed in a brown prison jumpsuit while his lawyers stated that they were not prepared to proceed with the trial as they required more evidence from the state attorney’s office.
The defense requested more time, but the prosecutors were ready for trial. The judge granted the defense the opportunity to present their case for an extension.
Derek Rosa is currently being held at the Metro West Detention Center, facing a murder charge for the killing of his mother on October 12th. He is being charged as an adult for this crime. Rosa appears to have bloodstains on his hands in the prosecutor’s image of him taking a selfie.
When Garcia was killed, Rosa was an 8th-grade student at iMater Academy in Hialeah. Currently, she has been arrested and charged with murder in connection with Garcia’s death.
In February, a video was released that showed the teenager conversing with his mother just hours before her passing. In the obtained footage, Rosa can be seen conversing with Garcia at their apartment on October 12th through the doorbell camera.
As the camera rolls, we see him turning the doorknob and stepping into the apartment. Garcia is seated on a chair with her newborn baby cradled in her arms.
In the short video, he questions her in Spanish, “Why do you consistently advise me not to run?”
As Rosa spoke on the phone with a 911 dispatcher, additional footage captured the moment she provided the apartment number.
As the police lights flash in the distance and officers approach the apartment, another video captures him opening the door. While awaiting trial, Rosa is being held without bond and is facing charges as an adult.
